EOC week 11: FInal Evaluation

This class was a very interesting class for me. At first I thought this class would be boring like social studies. At the beginning, I was not really interested of things that the teacher was talking about. I couldn’t understand anything so I read the book to see if I could recognize what the teacher was talking about. But, I still didn’t understand any of it. The couple of weeks I was in this class I was struggling but the teacher was really patient and explained everything clearly. Now I have understanding on what Patent, Copyright, and trademark and I’m really glad I signed up for this class. I learned a lot and now, I know what to do incase I get problems in all my artworks. Taking into consideration the points obtained in the above grid I think I should have at least a B grade. I missed a couple of EOC and had some late twits on my twitter. I think I did good in this class because even though I missed some works. I understood the class and actually had fun. A great class students should take because it will help them in the future when they become professionals and working in a big company. They know when to sue, and know what to do and where to go if ever they have a problem. Overall I enjoyed this class and I think I deserve a B for participating and doing works in this class. But when talking about how I understood this class, I think I deserve an A. I also think I deserve this grade because I tried all things that are required for weekly projects and finals.

5. Your Own Argument and Opinion

Like what I said in previews questions, the answers I was seeking for, for my questions was really not what I expected. I thought lawyers knew everything about copyrights, trademarks, or patent, but I was surprised that some of my questions were not answered. He was always saying the word depends and some of his answers were confusing me because of what I learned in class. When my teacher answer question, he gives examples and explains it well but Herbert was lacking explanations to his answers.

I was also nervous to make an argument because knowing how they answer back, they might say something and ask me questions I wouldn't know the answer to. So, instead of arguing, I just listened to what he said and just got over the project as soon as I can.

If ever I have questions about Patent, Trademarks, or copyrights, I would definitely ask my teacher (Mr. Pinto) instead of lawyers. Although it was a good experience, I would rather read the book instead of going back to his office and ask questions.

4. Rule of Law

My Lawyer didn't really quote anything from the book. He was just to the point on answering whether it was yes or no or it depends. He was more like answering it as fast as he could so I could get out already.

Anyway the interview didn't really last long, but my experience being in that room was very fun for me. If ever I have any questions, I think I would go and ask lawyers again and get the experience dealing with them.

Overall, although the the interview was really fast, it was a good experience.

3. Reasoning of the Law

I would say the Attorny's answers to my questions were to the point. He didn't really waste time on answering it. He usually answers it with " it depends," and then he would look at me and ask me questions about my questions. It was actually a funny experience because, everytime he ask me a question, I would look at him and my brain just freeze because I don't know how to answer him. But I think he was smart enough to understand that this student is probably not the best person to ask questions.

The interview really didn't last long, although he explained some questions to me, I felt like I needed more explanation. I couldn't understand some of his answers because he was busy asking me questions intead of answering it. I wished I had more time so I can ask him more questions but you know how lawyers are, they seem to be in a hurry to answer.

My experience with Herbert was fun but I wished I had more time so I could ask other lawyers also. I wanted to find out if they have a different answers to my questions but again, I was nervous that they would hang up or just charge me stuff. But overall, I rather ask my teacher for this class to answer my questions because he explains it to us better :)

2. My 10 Questions

1. If I lose inspiration and go online and use someone else’s design, more than I intended to. Will I be safe from a lawsuit if I changed it enough so it isn’t exactly the same? What recourse do I have if the roles are reversed, if my work is the work being stolen?

* No, no one is really safe in this kind of situations, it really depends on how you changed the design. If the roles are reversed, you can sue for injuction and damages.

2. If I’m asked to sign a non-disclosure agreement can I use the skills that I developed in the company to earn money through free lance work?

*It actually depends on wording of nondisclosure agreement.

3. As a designer working for an employer can part of a design, from that company, be considered as a trade secret that I’m prohibited from using any work that was not solicited from within the firm?

* It depends on what the agreement does. You still can be sue depending on what their rules are and what you signed. They have the right to do so.

4. If I come up with an original idea during employment with a company who owns the rights to it? Myself or the company? Is there any way I can make it my own to sell to others?

* Again, It depends on what the agreement says.

5. How much do you charge to read a contract and advise/interpret it for me?

* I don't charge

6. Can I protect multiple intellectual properties under one single copyright? Is it better to do this or to copyright each individual component?

*Yes, I would suggest to copyright each individual component

7. What rights do I retain when using company software?

* Depends on the software, if you need to buy the software in regular price then thats what you have to do. No downloading free over the internet.

8. If I create a design, but am not paid for it, what recourse do I have?

* Again, you can sue for injuction and damages.

9. If someone steals my intellectual property how do I establish ownership?

* Copyright

10. If my employer gives me specific guidelines for a design, but those guidelines infringe on another IP, am I liable for it?

* Possibly
